Please read these Terms and Conditions (“Terms”) carefully. By accessing or using the services provided by the Deshik Welfare Foundation on deshik.org, you agree to be bound by these Terms, along with any policies referenced within, including our Privacy Policy.

1. General Terms and Acceptance

The Deshik Welfare Foundation operates an online crowdfunding and donation platform (the “Platform” or “Service”) that connects verified individuals, institutions, and NGOs with donors who wish to support charitable and social causes across India. To use our services, you must be at least 18 years old and legally competent to enter into a contract under the Indian Contract Act, 1872.

We reserve the right to modify or update these Terms at any time. Any changes will be posted on this page, and your continued use of the Platform will signify acceptance of the updated Terms. Please review this section periodically to stay informed.

The Deshik Welfare Foundation functions solely as an intermediary service provider, facilitating transparent connections between campaigners and donors. We do not act as a financial institution or investment vehicle.

2. Terms Applicable to Donors

All donations made through the Platform are voluntary and philanthropic in nature. When you contribute to a campaign, you acknowledge that your contribution is not an investment and does not entitle you to any form of financial return such as interest, profit share, or equity. Once funds are legally disbursed to the verified campaigner, the Deshik Welfare Foundation is not responsible for how those funds are ultimately used, provided they were transferred in compliance with our verification process.

Donation, Refund, and Cancellation

All donations made through the Platform are immediate and irrevocable. Once a donation is successfully processed, it cannot be canceled or refunded. Refunds are permitted only in limited, verifiable cases—such as duplicate transactions or when a campaigner’s verification is revoked before disbursement. Refund requests are reviewed individually and may be subject to deduction of payment gateway charges.

Eligibility for tax benefits under Section 80G of the Income Tax Act, 1961 depends entirely on the legal status of the recipient NGO or institution. While the Deshik Welfare Foundation facilitates the process, the responsibility for issuing the 80G certificate rests solely with the recipient NGO, not with the Foundation.

3. Terms Applicable to Campaigners and NGOs

If you are a campaigner—whether an individual, NGO, or institution—you must submit valid identification and supporting documents such as PAN, Aadhar, and relevant registrations (12A/80G, etc.) to complete verification before your campaign can go live. This verification is mandatory and designed to maintain trust and compliance.

As a campaigner, you are solely responsible for ensuring that all funds raised are used only for the charitable purpose stated in your campaign description. You are required to provide transparent and honest updates to donors and the Platform, including photos, videos, and reports on fund utilization and impact.

The Deshik Welfare Foundation charges service and payment gateway fees, which are deducted from the total amount raised before disbursement. The applicable charges are detailed in our Pricing Policy. The Foundation also reserves the right to hold, suspend, or recall funds if there is evidence or suspicion of misuse, or if campaigners fail to provide adequate progress or impact reports.

4. User Content and Intellectual Property

You retain ownership of all original content (such as text, images, and videos) that you upload to the Platform. However, by submitting such content, you grant the Deshik Welfare Foundation a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it for purposes of promoting your campaign and the Foundation’s mission.

You agree not to post any material that is unlawful, defamatory, obscene, misleading, or infringes on the intellectual property rights of others. The Deshik Welfare Foundation reserves the right to remove any content that violates these guidelines or applicable law.

5. Disclaimers and Limitation of Liability

The Platform and its services are provided on an “as is” and “as available” basis. The Deshik Welfare Foundation does not guarantee that the Platform will be uninterrupted, error-free, or completely secure. We do not warrant that any campaign will achieve its funding goal or that donor contributions will result in specific outcomes.

The Deshik Welfare Foundation will not be liable for any direct, indirect, incidental, or consequential damages that arise from your use of, or inability to use, the Platform—including but not limited to loss of data, revenue, or goodwill.

6. Governing Law and Jurisdiction

These Terms are governed by and shall be interpreted in accordance with the laws of India. Any disputes arising out of or related to these Terms shall fall under the exclusive jurisdiction of the courts located in Patna, Bihar, India.
